C.M.P.No.29346 of 2023 IN W.A.SR.No.160642 of 2023 R.MAHADEVAN, J.

AND MOHAMMED SHAFFIQ, J.

(Order of the court was made by R.Mahadevan, J.) This miscellaneous petition has been filed by the petitioners seeking to condone the delay of 562 days in filing the above writ appeal.

2. Heard the learned Special Government Pleader appearing for the petitioners and perused the affidavit filed in support of this petition, wherein, it has been stated that the copy of the order dated 29.04.2022 passed by the learned Judge in W.P.No.15007 of 2010, which is impugned herein, was received by the office of the 2nd appellant on 15.06.2022. After obtaining legal opinion, administrative sanction and service particulars of the writ petitioner, the appeal papers were made ready and sent for approval of the office of the Government Pleader, for filing the same in the Registry. Thus, there was a delay of 562 days occasioned in filing the appeal, which is neither wilful nor wanton and hence, the delay may be condoned.

3. Having regard to the reasons stated by the petitioners, which appears to be bona fide, considering the huge delay in filing the writ appeal, we are inclined to condone the delay subject to payment of costs of Rs.1,000/- by the petitioners to the Tamil Nadu Mediation and Conciliation Centre, High Court, Madras, within two weeks time from the date of receipt of copy of this order. https://www.mhc.tn.gov.in/judis
