This Criminal Miscellaneous Petition is filed under Section 483 of Cr.P.C and Section 528 of BNSS, 2023 praying to relax the condition imposed in Para 6(c) of the judgment by this Court in Crl.M.P.No.9477 of 2024 in Crl.R.C.No.1124 of 2024 dated 01.07.2024 in respect of condition No.6(c) the petitioner shall be report before the VII Additional Sessions Judge every month first working day at 10.30 a.m., until further orders. ORDER
This Criminal Miscellaneous Petition has been filed by the petitioner praying to relax the condition imposed in Paragraph No.6(c) of the Order dated 01.07.2024 in Crl.M.P.No.9477 of 2024 in Crl.R.C.No.1124 of 2024 passed by this Court.
2. The learned counsel for the petitioner submitted that this Court vide Order dated 01.07.2024 in Crl.M.P.No.9477 of 2024 in Crl.R.C.No.1124 of 2024, suspended the sentence imposed on the petitioner by the learned Metropolitan Magistrate, Fast Track Court II, Egmore, Allikulam, Chennai vide Judgment dated 15.02.2023 in C.C.No.1772 of 2021 on the following conditions:
"(a) The petitioner shall pay a sum of Rs.1,00,000/- (Rupees One Lakh Only) to the respondent immediately and shall file a proof to that effect before the trial Court; (b) The petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) to the satisfaction of the learned Metropolitan Magistrate, Fast Track Court No.II, Egmore at Allikulam along with two sureties for a like sum; (c) The petitioner shall report before the Court below on the first working day of every month at 10.30 A.M., until further orders."

It is further submitted by the learned counsel for the petitioner that out of the cheque amount of Rs.18,00,000/-, petitioner has paid a sum of Rs.11,00,000/- to the respondent and now, the balance amount payable to the respondent by the petitioner is Rs.7,00,000/-. 2.2. The learned counsel for the petitioner submitted that as per the condition imposed by this Court in Paragraph No.6(c) of the Order dated 01.07.2024 in Crl.M.P.No.9477 of 2024 in Crl.R.C.No.1124 of 2024, the petitioner has been reporting before the VII Additional District and Sessions Court, Chennai on the first working day of every month at 10.30 a.m, without fail.
2.3. It is also submitted by the learned counsel for the petitioner that the petitioner has some health issues and he wants to settle the issue amicably. Therefore, the learned counsel prayed that the condition imposed by this Court in Paragraph No.6(c) of the Order dated 01.07.2024 in Crl.M.P.No.9477 of 2024 in Crl.R.C.No.1124 of 2024 may be relaxed and the case may be referred to Mediation.
3. The learned counsel appearing for the respondent submitted that he has no serious objection to the aforesaid condition being relaxed by this Court.

4. Considering the submissions made by the learned counsel on either side, the condition imposed by this Court in Paragraph No.6(c) of the Order dated 01.07.2024 in Crl.M.P.No.9477 of 2024 in Crl.R.C.No.1124 of 2024 is relaxed.
5. Registry is directed to list the case before Tamil Nadu Mediation and Conciliation Centre, High Court, Madras on 12.11.2025 and after the completion of mediation, list the same before this Court on 10.12.2025, along with the Mediation Report.
6. The Mediator is directed to fix a date for hearing the parties and issue notice to the parties. On receipt of such notice, the parties shall appear before the Mediator on the hearing date fixed by the Mediator, without fail. 25.10.2025 mrr Index: Yes/No Speaking Order (or) Non-Speaking Order To 1.The VII Additional District and Sessions Court, Chennai.
