Comp.A.Nos.268 & 269 of 2018 were disposed by a common order passed by this Court vide its order dated 13.10.2023. The respondent in Comp.A.No.269 of 2018 has filed Comp.A.No.67 of 2024 to recall the order of this Court dated 13.10.2023 as Comp.A.No.269 of 2018 was not listed although the Company Application was available before this Court.

2. It is therefore submitted that the order passed by this Court on 13.10.2023 in respect of Comp.A.No.269, it may be recalled so that suitable submissions can be made by the applicant.

3. The learned counsel for the applicant would draw attention to the Cause List dated 13.10.2023.

4. The submission of the applicant is taken note of. On perusing the cause list of this Court dated 13.10.2023, it is noticed that Comp.A.No.269 of 2018 was not listed in the cause list. It appears that the application was available before the Court and thus order came to be passed on 13.10.2023.

5. Considering the same, common order passed by this Court on 13.10.2023 in so far as Comp.A.No.269 of 2018 is concerned is recalled. Accordingly, Comp.A.No.269 of 2018 is restored back to the file of this Court.
