ORDER

The petitioner, who was arrested and remanded to judicial custody on 28.07.2025, for the offences punishable under Sections 303(2) of 2025 in Crime No.394 of 2025, registered on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioners joined hands with other accused board the bus which was over crowded and travel in the bus along with passengers and steal the high value cell phones and will sell the same in the same to others. It is also stated that all the accused persons will steal the cell phones in Tambaram and will sell the same near Parrys bus stand. Hence, this case.

3.The learned counsel appearing for the petitioners submitted that for the very same allegations four F.I.R was filed which itself reveals that the respondent has foisted false case against the petitioners. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioners. 4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioners, reiterated the prosecution case and states that all the petitioners belong to Odissa and Andhra Pradesh. He further submitted that the accused persons used to travel in the MTC Buses in Tambaram and all of them has come to Chennai only to steal the high value cell phones. So far 14 cell phones was 2/4

recovered.

5. I have gone through the statement of the A1 wherein he has stated that three persons among themselves will board the bus and will steal the high value cell phones and sell the same and they acted as different batches in different areas and commit offences.

6. Considering the facts of the case and the manner in which the offence has taken place and only 14 cell phones was recovered and the remaining cell phones are not yet recovered, this Court is not inclined to grant bail to the petitioners.
