ORDER

Challenging the order of the Trial Court dismissing the application filed to summon the document filed before the RERA authority.

2. The petitioner is facing a cheque complaint under Section 138 of NI Act and the same has been taken cognisance in C.C.No.22 of 2017 on the file of the learned XXVII Metropolitan Magistrate, Saidapet, Chennai. When the above case was posted before the Trial Court, the petitioner filed 1/4

the application under Section 94 of BNSS to summon certain documents said to have been filed by the complainant before the RERA. The Trial Court has dismissed the application vide order dated 24.07.2025.

3. At the outset, I do not find any merits in this petition. It is well open to the petitioner to apply for certified copies before the RERA, on such application, the concerned authority shall issue certified copies. On obtaining the certified copy, it is for the petitioner to file the same before the Trial Court. At any event, the entire exercise shall be completed within a period of two months.

4. Accordingly, this petition stands dismissed. Consequently, connected miscellaneous petition stands closed. 07.10.2025 dhk To 2/4
