These Civil Miscellaneous Petitions are filed to (i) set aside the abatement caused due to the death of the 3rd petitioner (ii) bring on record the proposed petitioners herein as the legal representatives of the deceased 3rd petitioner namely Arumugam.
2. Heard the learned counsel for the petitioner and the learned counsel for the respondents who submits that he has got no serious objection in allowing this petition.
3. Taking into consideration the reasons stated in the supporting affidavit and the legal heirs certificate produced, this Court is satisfied that sufficient cause has been made out and that the proposed parties are the legal heirs of the deceased third petitioner.
4. Accordingly, abatement is set aside. The 4th & 5th petitioners namely, Senbagavalli and Kanishkar are impleaded as the legal heir of the deceased third petitioner.
