ORDER

This contempt petition has been filed alleging violation of the order dated 02.07.2024 in W.P. No. 4160 of 2020. 1/4

When the matter is taken up for consideration, the respondent filed an affidavit contending that the petitioners 1 and 3 herein are not entitled for grant of incentive increment, as they were directly appointed to the post of B.T. Assistant, for which post, the B.Ed qualification is the minimum educational qualification. The said legal position is not disputed by the learned counsel for the petitioner. In view of the same, the question of the petitioners 1 and 3 being considered for grant of incentive increment in terms of the order passed by this Court in W.P.No.4160 of 2020 does not arise.

Insofar as the second petitioner is concerned the respondent has considered the case of the second petitioner and accordingly issued proceedings bearing Na.Ka.No.2905/AA1/2024 dated 25.01.2025, wherein it is stated that the second petitioner herein was already granted incentive increment while she was working as Secondary Grade Teacher through proceedings R.C.No.176/17/2014 dated 30.03.2017 issued by the Block Educational Officer concerned. In the light of the above, it cannot be said that the respondent has deliberately violated the orders passed by this Court.

4. Accordingly, the contempt petition is closed. However, in case the petitioner is aggrieved by the proceedings bearing Na.Ka.No.2905/AA1/2024 dated 25.01.2025, it is open for the petitioner to take appropriate steps in accordance with law. 31.07.2025 (5/6) Index : Yes/No Internet : Yes/No mtl 3/4
