praying for issuance of Writ of Mandamus, forbearing the 3rd respondent form proceeding with the enquiry pursuant to the summons dated 08.09.2025 in Na.Ka.No.0661/2025/A pending suit in O.S. No.54 of 2025 of the file the District Munsif Court, Kangayam, by considering our objection dated 25.08.2025 given in person and objection dated 13.09.2025 sent by RPAD.

ORDER

This Writ Petition has been filed challenging the summons dated 08.09.2025 issued by the third respondent, thereby calling upon the petitioners to submit documents and give explanations.

2. The learned counsel appearing for the petitioner submitted that, on receipt of the summons, the petitioner also submitted a detailed explanation with objections that a civil suit is already pending in respect of the very same subject property.

3. In view of the above, the third respondent is directed to consider the objections raised by the petitioner, after affording an opportunity of hearing to both parties, and pass appropriate orders on

merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order. 4 . With the above direction, this Writ Petition stands disposed of. Consequently, connected miscellaneous petitions are closed. No costs.
