A.No.6731 of 2023 in C.S.No.135 of 2021 N.SATHISH KUMAR. J., This application has been filed to permit the plaintiff to let in secondary evidences.

2. The first two documents are title deeds of the respondents. Hence, those documents are required to prove the extent and boundaries. Such being the case let the applicant first give notice to the respondents to produce the original documents before this Court, then the applicant is at liberty to file application as far as documents Nos.1 and 2.

3. As far as other documents are concerned, this Court is of the view that the documents will be received subject to the proof and relevancy and the same will considered only if the plaintiff has made foundation either in the pleadings or in the evidences for non production of originals.

4. Accordingly, this application stands ordered. Post the suit before the Additional Master III for recording evidence on 04.01.2024 and the evidences of both sides shall be completed on or before 29.02.2024.
