Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to dispose of the 1/6

appeal filed by the petitioner in Appeal No.221/A1/2025 against the order of the 2nd respondent dated 28.11.2024 in Na.Ka.No.2016/2024/A4, under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, relating to the cancellation of the settlement deed dated 27.07.2012 registered as Document No.4193/2012 on the file of the SubRegistrar, Virugambakkam, Chennai within a time frame to be fixed by this Hon'ble Court.

ORDER

This writ petition has been filed seeking to direct the 1st respondent to dispose of the appeal filed by the petitioner in Appeal No.221/A1/2025, within the time stipulated by this Court.

2. Mr.Yogesh Kannadasan, learned Special Government Pleader takes notice on behalf of the respondents 1 to 3. In view of the consent expressed by the learned counsel on either side, this writ petition is taken up for final disposal at the admission stage itself.

3. Since no adverse order is passed against the respondents 4 to 6, notice to the respondents 4 to 6 is dispensed with.

4. The case of the petitioner is that, aggrieved by the order of the 2nd respondent dated 28.11.2024 bearing Na.Ka.No.2016/2024/A4 passed in the application dated 28.03.2024 filed by the petitioner under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, seeking cancellation of the settlement deed dated 27.07.2012 registered as Document No.4193 of 2012, in and by which, the 2nd respondent, though, rejected the petitioner's request for cancellation of the above said settlement deed dated 27.07.2012, ordered for payment of Rs.10,000/- in favour of the petitioner payable by each of the private respondents, the petitioner preferred an appeal before the 1st respondent in Appeal No.221/A1/2025. However, till date, no orders have been passed on the said appeal. Hence, the present writ petition has been filed.

5. Learned counsel for the petitioner submits that, since the petitioner is a septuagenarian, it would suffice, if this Court issues a direction to the 1st respondent to dispose of the petitioner's appeal bearing No.221/A1/2025, as expeditiously as possible.

6. Learned Special Government Pleader appearing on behalf of the respondents 1 to 3 submits that appropriate orders will be passed on the petitioner's appeal bearing No.221/A1/2025, within the time stipulated by this Court.

Considering the limited prayer sought for by the petitioner, this Court, without going into the merits of the case, directs the 1st respondent to consider the petitioner's appeal in Appeal No.221/A1/2025 and pass appropriate orders on merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner, the respondents 4 to 6 and other aggrieved persons, if any.

8. With the above directions, this writ petition stands disposed of. No costs.
