ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025. 2.The case was registered in Cr.No.588 of 1996 for the alleged offence under Sections 39(1) and 44(1) (cc) of Indian Electricity Act. This is an occurrence of the year 1996. The case is pending from the year 1999 and the warrant is pending against the accused. It can be seen that the allegation is of electricity theft. The order that is passed in this case will not any manner come Page No.1 of 3

in the way of the electricity board recovering the charges that will run along with the property and recovering from either the accused person or any person claiming through the accused person or any person who is in possession of the property, if they are so eligible.

3. With the above back ground, since the case is pending from the year 1999 and it is stated that despite best efforts, the summons could not be served and warrant could not be executed. The case is pending from the year 1999, any further service or summon would impinge upon his right to a speedy trial of the accused and no useful purpose would be served.

4. Accordingly, the proceedings in CC.No.3258 of 1999 of XIV Metropolitan Magistrate Court, Egmore Taluk, Chennai, is quashed and this Suo Motu Transfer Case is disposed of.

24.09.2025 mtl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
