ORDER
This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.
2. The case was registered in Cr.No.91 of 2001 for the alleged offence under Sections 147, 148, 324 & 307 of I.P.C. The accused is suspected to Page No.1 of 3
have been died, however death certificate is not produced. In any event, it can be seen that the split up case as against the other accused, against whom the similar allegations are made, ended in conviction for lesser offence alone and the accused paid the fine. In that background when the existence of the accused itself is suspected. The case is pending from the year 2019 and no useful purpose will be served and right to speedy trial will also be impinge.
3. Accordingly, the case in C.C.No.982 of 2019 of XIV Metropolitan Magistrate Court, Egmore Taluk, Chennai, stands quashed. This Suo Motu Transfer Case is disposed of.
24.09.2025 mtl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
