ORDER
This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu.W.P.(Crl.) No.618 of 2025. Page No.1 of 3
2. The case was registered in Cr.No.382 of 2003 for the alleged offence under Section 399 of I.P.C. The allegation in this case is that the accused were preparing to commit dacoity and were arrested at that time. The case is pending at the stage of execution of warrant on the accused. Out of five accused, three accused have died. In respect of other accused, warrant pending. The occurrence is of the year 2003. It is stated that despite of best efforts summons could not be served and consequently, warrant pending. No other previous or subsequent case and no useful purpose will be served and right to speedy trial would impinge upon.
3. Accordingly, the proceedings in PRC.No.119 of 2004 of XIV Metropolitan Magistrate Court, Egmore Taluk, Chennai, is quashed and this Suo Motu Transfer Case is disposed of.
24.09.2025 mtl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
