IN THE HIGH COURT OF JUDICATURE AT MADRAS

DATED : 04.04.2025

CORAM

THE HONOURABLE Ms. JUSTICE P.T. ASHA in C.R.P.No.911 of 2024 Jamunarani ... Petitioner Vs.

1.Samicannou 2.Mohandass ... Respondents Prayer:- Civil Miscellaneous Petition is filed under Section 148 and Section 151 of CPC, 1908 to extend the time period for the compliance of the conditional order passed in CRP.No.911 of 2024 dated 04.11.2024. For Petitioner : M/s.S.Venkatesan For Respondent : Mr. Samicannou, Party in person (R.1) 1/4

O R D E R

The above petition is filed to extend the time period for the compliance of the conditional order passed in CRP.No.911 of 2024 dated 04.11.2024.

2. It is seen that by order dated 04.11.2024, this Court had allowed CRP.No.911/2024 setting out various conditions and one of the conditions was that the entire decree amount had to be paid with interest on or before 02.12.2024. However, the petitioner had not deposited the same. On the contrary, on 27.11.2024 she has taken out an application for extension of time for complying with the conditional order. This application had come up only on 25.03.2025 and since the respondent was a party in person, the Registry was directed to inform the party in person that the petition would be listed today. Today, the party in person appeared through video conferencing mode.

3. The learned counsel for the petitioner would submit that tomorrow the entire amount would be deposited. The learned counsel would also state that on 29.11.2025 itself the petitioner was ready with the money. However, this statement on the face of it is incorrect since on 2/4

29.11.2024, the petitioner had filed the application for extending the time for depositing the decree amount. Therefore, the petition lacks bonafide.

4. Accordingly, the above Civil Miscellaneous Petition stands dismissed. No costs.
