PRAYER in WP.Crl.No.982 of 2025 To issue a Writ of Mandamus or any other Writ, order or direction in the nature of a Writ, directing the 4th respondent to give adequate police protection to the petitioner, to enter into his property for constructing house, which is comprised in old survey No.119/1B to an extent of 2000 sq.ft, situated at N.Chinnappa Nagar, Elandhakuttai Village, Kumarapalayam Taluk, Namakkal District, by considering the petitioner's representation dated 23.05.2025. Mr.R.Vinoth Raja, Govt. Advocate (Crl. Side) COMMON ORDER The petitioners seek police protection to enter into their property for constructing house.

It is the case of the petitioners that they purchased plots from one Sugumar in i) Survey Nos.121/1E, 121/5B, 121/1D and 121/1A (WP.Crl.No.977 of 2025), ii) Survey Nos.121/1A and 121/3A (WP.Crl.No.978 of 2025), iii) Survey No.121/1A (WP.Crl.No.980 of 2025), iv) old survey No.121/4 (WP.Crl.No.981 of 2025) and v) old survey No.119/1B (WP.Crl.No.982 of

2025), respectively. After purchasing the property, the mutation was also effected in their name. When they plan to construct house, some of the neighbouring land owners, who belongs to Schedule Caste Community, objected the same on the ground that the property has already been settled in their favour. According to the petitioners, the property settled in favour of the neighbouring land owners are different survey numbers. Therefore, seeks police protection.

3. The learned Government Advocate (Crl. Side) on instructions submitted that the persons who are objecting the petitioners' construction is also claiming ownership and therefore, the parties are directed to produce the documents, but none appeared before the Police.

4. In such view of the matter, let both parties shall produce their documents before the respondent Police. If the Police after enquiring those documents found that the petitioners' property is in different survey numbers and noway connected to the property settled to the other group, then accord

necessary police protection on the basis of the complaint given by the petitioners.
