COMMON PRAYER : Criminal Original Petitions filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, to enlarge the petitioner on bail in Crime No.394 of 2025 pending investigation on the file of the respondent police.

The petitioners, who was arrested and remanded to judicial custody on 04.09.2025 for the alleged offences punishable under Sections 4(1)(aaa) r/w 4(1-A) of the TNP Transport Act, 2024, in Crime No.394 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioners, these petitioners along with three other petitioners have involved in transporting of 48 Black pearl beer bottles (each in 750 ml), 24 Directors club brandy bottles (each in 750 ml), 100 Directors club brandy bottles (each in 90 ml), 48 King Louis Brandy bottles (each in 180 ml) and 110 liters of illicit arrack in the Car and Twowheeler.

3. The learned counsel for the petitioners submitted that the petitioners are in custody for the longer period and he prayed for bail.

4. Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent police reported that these petitioners were arrested, while transporting huge quantity of liquor and the investigation is pending and the three accused persons are yet to be apprehended and apart from that the 2/4

petitioners are also having previous cases, (A1-3 previous cases & A2-3 previous cases) against them.

5. Considering the fact that the petitioners are having 3 previous cases against each of them and also they are transporting huge quantity in the Car and Two-wheeler, this Court is not inclined to grant bail to the petitioners.
