This Criminal Original Petition has been filed seeking a direction to the first respondent to transfer the investigation in Crime No.255 of 2025 registered for "Man Missing",on the file of the second respondent to the third respondent.

Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondents.

The contention of the learned counsel appearing for the petitioner is that the petitioner had lodged a complaint before the second respondent alleging that her son, who is suffering from mental illness, was missing. Based on the complaint, a case in Crime No.255 of 2025 was registered on the file of the second respondent Police on 06.06.2025. However, thereafter, no progress has been made in the investigation. Therefore, the petitioner has filed the present petition seeking transfer of the investigation.

Learned Government Advocate (Criminal Side), on instructions, submitted that the petitioner's son is not only affected with mental illness but is also addicted to alcohol. Further, he was deserted by the family and had gone to meet his wife, after which, he did not return home. In this regard, all necessary steps have been taken by the Investigating Officer, including issuing public notices. He further submitted that the investigation is being conducted in all proper directions. 5.

Be that as it may, considering the facts of the case and the submissions made by the learned Government Advocate (Criminal Side) that wide publicity has been given in search of the missing person and that unclaimed bodies in hospitals are also being checked, this Court is of the view that the second respondent Police are conducting the investigation in a proper manner. Accordingly, no transfer of investigation is required in this case. The Investigating Officer is directed to proceed with and complete the investigation at the earliest.

With the above directions, this Criminal Original Petition stands disposed of.
