S.No.28/3 an extent of 4531 Sq.ft. Survey No.28/4 an extent of 850 Sq.ft. and Survey No.28/2 an extent of 1235.5 sq.ft. in total extent of 6618.5 sq.ft with help of 4th respondent to put the fence the above said property within a time.

ORDER
This Writ Petition had been filed seeking a direction to the second and third respondents to take steps to measure and demarcate the subject property and to issue a patta.
2. Heard the learned counsel appearing on either side and perused the materials available on record.

It is seen that there was a dispute between the petitioner and the counter parties claiming ownership of the subject property comprised in Survey No.28/3, measuring an extent of 4531 sq.ft., Survey No.28/4, measuring an extent of 850 sq.ft. and Survey No.28/2, measuring an extent of 1235.5 sq.ft. in total extent of 6618.5 sq.ft, situated at Tinnaballur Village, Kanjalanathan Post, Pennagaram Taluk,
Dharmapuri District. In this regard, two complaints had already been lodged and CSR were issued. Though both the CSRs were closed, the title in respect of the subject property cannot be decided by the Revenue Authorities, as such dispute falls within the jurisdiction of the competent Civil Court.
4. In view of the above, the representation submitted by the petitioner cannot be considered, since the dispute involves question of title, which cannot be adjudicated by the Revenue Authorities. The petitioner ought to have approached the civil Court for appropriate relief. If the petitioner succeeds in the civil proceedings, she can very well approach the Revenue Officials for issuance of patta, based on the outcome of the said proceedings.
