This application is filed to condone the delay of 485 days in filing the written statement in the above suit.

2.Heard both sides and perused the averments in the affidavit filed in support of the application.

3.This Court vide order dated 02.01.2024 allowed the application subject to payment of cost of Rs.10,000/- to the Cancer Institute, Adyar, Chennai.

4.Now the learned counsel appearing for the applicant/ defendant submits that the applicant had paid the cost and filed the written statement.

5.Having regard to the said submission, this application filed by the defendant is ordered and the delay is condoned. The written statement is taken on record.
