This Civil Miscellaneous Petition has been filed to condone the delay of 388 days in filing the above appeal.

2. Heard the learned counsel for the petitioner and respondent No.1.

3. The learned counsel for the respondent No.1 has raised serious objection in allowing this petition.

4. The petitioner would state that the copy of the order was misplaced, and he is not in a position to calculate the period of limitation for filing the https://www.mhc.tn.gov.in/judis

kkd appeal. He would also further state that the papers were sent to the present counsel for filing the appeal, and thereby delay of 388 days occurred in filing the present appeal.

In consideration of the above said details and in order to have effective justice, this Court is inclined to allow this petition, subject to the condition on payment of costs of Rs.1000/- payable in favour of the Cancer Institute (WIA), Gandhi Nagar Canal Bank Road, Adyar, Chennai - 20 (payable in S.B.A/c.No.149710011000002, Union Bank of India, Madhya Kailash Branch, Cancer Institute (WIA) Campus, Sardar Patel Road, Chennai36, Branch Name and Code : 1497, MICR No.600011049, IFSC Code : UBIN0814971), on or before 22.10.2025.
