Prayer:- Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, to call for the records relating to the F.I.R.C.C.No.362/2003 CS/CID, Salem of the third respondent dated 19.10.2003 as well as the order of the second respondent in C.Pa.199/2003/F3, dated 22.10.2003 and quash the same and consequently forbearing the respondents in any way interfering with the trading activities of the first petitioner in white kerosene including selling of white kerosene to lorry and other needy persons by refunding Rs.20,000/- paid by the second petitioner by way of security deposit on 22.10.2003 pursuant to the order of the second respondent in C.Pa.199/2003/F3 dated 22.10.2003. The learned counsel appearing for the petitioners would submit that inspite of his earnest efforts there is no instructions from the petitioners to pursue the case further. The learned counsel has also made an endorsement in the Court bundle, today, to that effect.
2. In view of the same, this writ petition is dismissed for non prosecution on the side of the petitioner. No costs.
