PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus, calling for records relating to the order of the 1st respondent made in O.Mu.No.2956/Aa2/2023 dated 13.06.2023 and consequently the 2nd respondent made in Na.Ka.No.3824/Aa6/2023 dated 09.08.2023 to quash the same and consequently direct the respondents to approve the appointment of the petitioner w.e.f 28.10.2022 with other service accruals thereto. The writ petition is filed for the relief herein below set out: " calling for records relating to the order of the 1st respondent made in O.Mu.No.2956/Aa2/2023 dated 13.06.2023 and consequently the 2nd respondent made in Na.Ka.No.3824/Aa6/2023 dated 09.08.2023 to quash the same and consequently direct the respondents to approve the appointment of the petitioner w.e.f 28.10.2022 with other service accruals thereto."
2. The brief facts which has culminated in the filing of this writ petition are set out below:
2.1. It is the case of the petitioner that she was working as a Management staff in 3rd respondent School as a PG Assistant (Commerce). On 31.05.2000, a vacancy arose for the post of P.G Assistant in Commerce Department in the petitioner school. The petitioner had conducted an interview and issued appointment order to the petitioner on 28.10.2022. Despite joining 2/5
duty on the same day, the petitioner was not paid any salary because her appointment was not approved by the authorities concerned.
3. It is the contention of the petitioner that although a vacancy arose in June 2000, earlier appointments to the post were challenged in W.P. Nos. 14777 and 15242 of 2014 wherein, this Court by Order dated 09.12.2020 had held that since there had occurred certain irregularities in the selection process, those selections were cancelled and further, directed the respondent to take steps to fill up the said post by following the procedure laid down under the Tamil Nadu Private School Regulation Act.
4. The proposal seeking approval of the petitioner's appointment with all enclosures had been sent to the competent Authorities for approval. But the 1st respondent had rejected the petitioner's claim vide proceedings in O.Mu.No.2956/Aa2/2023 dated 13.06.2023 and consequently the same had been communicated through 2nd respondent vide proceedings in Na.Ka.No.3824/Aa6/2023 dated 09.08.2023. Hence, the petitioner is before this Court.
5. Heard the learned Counsels on either side and perused the records. 3/5
6. It is seen that this Writ Petition has been filed by the 4th Respondent in W.P.No.7785 of 2024, challenging the very same impugned order. In the light of the order passed in W.P.No.7785 of 2024, this Writ Petition is allowed. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
