Apprehending arrest in connection with Crime No.102 of 2024 registered for the offences punishable under Sections 296(b), 118(1), 351(3) of BNS r/w Sections 152 and 153 of Indian Railways Act, the present petition has been filed seeking anticipatory bail. 2.Pleading innocence on the part of the petitioner, false implication in the case, learned counsel for the petitioner seeks indulgence of this Court. Learned counsel for the petitioner would submit that the petitioner is innocent and a false case has been foisted against him since he happens to be a friend of other accused and he was not at all present in the scene of occurrence. He further submits that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. 3.The case of the prosecution as putforth by the learned Government Advocate (Crl. Side) appearing for the respondent Police, opposing for grant of anticipatory bail, is that the petitioner is one of the gang members, he Page No.1 of 3
along with the other accused without any provocation had assaulted the passengers waiting in the railway platform and caused injuries to them. He further submit that the arrested accused (A1 & A3) are still in custody and the presence of the petitioner is required for the purpose of identification. 4.Taking into consideration the serious offence committed by the petitioner along with other accused, this Court is not inclined to grant bail to the petitioner.
