Respondents Prayer : Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus to direct the third respondent to inspect the layout and any violation in the layout approval No.50 of 2024 given in favour of the 7th and 8th respondents and cancel the same and direct the 5th respondent not to allow any registration based on the violated layout approval.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) After having gone through the counter filed by the State, we do not consider it necessary to keep pending this petition.

2. The grievance of petitioner seems to be that the developers, while publishing maps in the brochures and advertisements, are not giving correct description of the layout.

3. Whether or not this would render the developer liable for any action in the hands of the State authorities is not demonstrated with reference to any rule or conditions of approval.

3. Be that as it may, if petitioner has made any application before the authority, it is open for that authority to examine the same. No writ can be issued to private respondents in public interest litigation.
