ORDER

The petitioner, who was arrested and remanded to judicial custody on 19.08.2025, for the offences punishable under Sections 126(2), 127(2), 296(b), 310(2), 311 and 351(3) of BNS in Crime No.257 of 2025, registered on the file of the respondent police, seeks bail. 2.

The case of the prosecution is that the petitioner along with other accused waylaid the defacto complainant and demanded money; that on refusal, they forcefully robbed a sum of Rs.5,000/- at knife point from the defacto complainant. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner was falsely implicated in this case and the petitioner is in judicial custody since 19.08.2025 and the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the 2/4

prosecution case and states that there are totally 6 accused and the petitioner is arrayed as A4 in this case. He further submitted that petitioner has six previous cases, out of which three cases of similar nature and he is a habitual offender; and that the investigation is pending. 5.

Considering the facts, gravity of offence, the prrevious antecedents of the petitioner and the investigation is pending, this Court is not inclined to grant bail to the petitioner. 6.

Accordingly, this criminal original petition stands dismissed. 23.09.2025 stn To
