Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, direction to the 2nd respondent to dispose of the Petitioner's appeal dated 05.11.2024 within the time stipulated by this Honble Court.

O R D E R

Seeking a mandamus directing the 2nd respondent to dispose of the appeal dated 14.10.2024, the petitioner is before this Court.

2. The grievance of the petitioner is that patta cancellation proceedings had been initiated on the basis of a complaint given by a neighbouring land owner one Selvam that 0.14 3⁄4 cents of his lands had been wrongly included to the petitioner's and his brother's land. On the basis of this complaint, the Tahsildar instead of modifying the patta had given a report to the Revenue Divisional Officer to cancel the patta.

The 3rd respondent/ Revenue Divisional Officer, on the basis of this report without conducting an enquiry and without notice to the petitioner had cancelled the patta for the entire extent of 70 cents. Aggrieved by the same, the petitioner had filed an appeal before the 2nd respondent on 05.11.2024. However, the same has not been considered to date. Therefore, the petitioner has filed the above Writ Petition seeking an early disposal of the said appeal.

5. Though the complaint has been given in respect of an extent of 14 3⁄4 cents of land, the patta for the entire land has now been cancelled. The appeal filed challenging this order is pending since 05.11.2024. Therefore, a direction is issued to the 2nd respondent to dispose of the petitioner's appeal dated 05.11.2024, within a period of 4 months from the date of receipt of a copy of this order.

6. Accordingly, the Writ Petition is allowed.
