This petition has been filed seeking to re-open the Contempt Petition No.1256 of 2023 which was closed on 22.09.2023. 2.The grievance of the petitioner is that though the petitioner has paid the entire cost of the plot, the Housing Board has not come forward to execute the sale deed. Ventilating such grievance, the petitioner made representation to Housing Board and since the same was not considered, filed W.P.No.11372 of 2018. This Court vide order dated 18.02.2019 disposed of the writ petition directing the respondent herein to consider the said representation and to pass appropriate orders. For non compliance of the order, the petitioner filed Contempt Petition No.1256 of 2023.

3.This Court passed a detailed order on 01.09.2023 and directed the respondent to appear before this Court on 22.09.2023 for pronouncing orders. On 22.09.2023, the learned counsel who appeared on behalf of the respondent submitted that the respondent 1/3

filed L.P.A.No.9 of 2023 before the Hon'ble Division Bench of this Court and the Hon'ble Division Bench of this Court granted an order of interim stay in L.P.A.No.9 of 2023 and C.M.P.No.21800 of 2023. Hence, the contempt petition was closed.

4.The learned counsel appearing for the petitioner submitted that L.P.A.No.9 of 2023 was withdrawn by the respondent on 19.10.2023 without any liberty. Hence, this sub application has been filed by the petitioner.

5.In view of the above, this sub application is ordered and the contempt petition in Cont.P.No.1256 of 2023 is reopened. 6.Registry is directed to list Cont.P.No.1256 of 2023 on 26.04.2024.
