ORDER

This writ petition has been filed challenging the impugned proceedings of the 2nd respondent dated 11.06.2025 and for a consequential direction to the 2nd respondent to transfer the patta in the name of the petitioner and other with respect to the subject property.

2.Heard Mr.K.Karthik, learned counsel appearing on behalf of the petitioner and Mr.C.Jayaprakash, learned Government Advocate appearing on behalf of the respondents.

3/6 3.In the considered view of this Court, the petitioner has an efficacious and alternative remedy before the Revenue Divisional Officer under the provisions of the Patta Passbook Act. Therefore, the petitioner has to necessarily file an appeal before the concerned Revenue Divisional Officer. However, the petitioner seems to have filed an appeal before the 1st respondent, the 1st respondent is not an appellate authority against the order passed by the Tahsildar.

4.In view of the above, liberty is granted to the petitioner to submit an appeal before the Revenue Divisional Officer and on receipt of the same, the concerned Revenue Divisional Officer shall deal with the same on its own merits and in accordance with law and pass orders, within a period of eight weeks from the date of receipt of the appeal from the petitioner. The rival parties shall also be given opportunity before final orders are passed by the Revenue Divisional Officer.
