This case is taken up for settlement before the National Lok Adalat. Both the parties are present. Mr.R.Kalaiarasan, learned counsel for appellant and Mr.J.Chandran, T.Killivalavan, R.Ranganatha Naidu learned counsel for the second respondent are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows: TERMS OF SETTLEMENT The Claimant is the appellant challenging the award of the Tribunal to the tune of Rs.11,40,000/- awarded by the Tribunal in M.C.O.P.No.6142 of 2018 dated 21.10.2024.

2. Today, 13.12.2025, the officials of the Insurance Company and the appellant/claimant along with their respective counsels are present. The appellant is not only physically challenged by also mentally challenged and he is also represented by his guardian and grand father and next friend viz., Ayyanar.

3. After negotiation, the parties have now arrived a sum of Rs.6,00,000/- over and above the lower Court awarded amount in full quit. We are satisfied that the interest of the mentally challenged appellant is sufficiently taken care of.

4. It is brought to the notice that the amount awarded by the Tribunal has already been deposited and withdrawn. The remaining amount shall be deposited within a period of eight weeks from the date of receipt of a copy of this award.

5. On such deposit, the claimant is permitted to withdraw the enhanced amount without filing any formal petition. Award is passed accordingly.

6. The Tribunal is directed to transfer the amount through RTGS/NEFT to the parties concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly.
