ORDER

The petitioner, who was arrested and remanded to judicial custody on 18.08.2025, for the offences punishable under Sections 305(b) of the BNS (under Section 380 of IPC) in Crime No.406 of 2025, registered on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner had committed a theft of Rs.6,84,000/- from the defacto complainant in the bus. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner was falsely implicated in this case and the petitioner is in judicial custody since 18.08.2025 and the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and states that the petitioner is hailing from Madhya 2/4

Pradesh and out of the stolen amount only Rs.5,50,000/- was recovered and the balance amount still not recovered; and that the investigation is pending.

Considering the facts, gravity of offence, the balance money has not yet been recovered, taking note of the fact that granting of bail to the petitioner will hamper the investigation and tampering of evidence and the investigation is pending, this Court is not inclined to grant bail to the petitioner.

Accordingly, this criminal original petition stands dismissed. 23.09.2025 stn 3/4
