PRAYER : Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus calling for the entire records pertaining to Impugned Order passed by the 3rd respondent in Na.Ka.No.1361/2025/A1 dated 12.06.2025 and quash the same as prohibitory and illegal, and consequently direct the respondents to ensure that all community people and general public including the petitioner are allowed to Donate as Uayadharar in 'Arulmighu Kamatchi Amman Udanurai Arulmigu Thirunageswarar Swamy Temple', Kundrathur irrespective of any preexisting donators or particular caste, class and community of people. Challenging the order passed by the 3rd respondent, the present Writ Petition has been filed.
2. Mr.S.Ravichandran, learned Additional Government Pleader (HR &CE) takes notice on behalf of the respondents.
3.It is the case of the petitioner that he is an ardent devotee of the Arulmigu Kamatchi Amman Udanurai Arulmigu Thirunageswarar Swamy temple, Kundrathur. He had submitted a representation dated 22.04.2025 to the respondents requesting to allow people belonging to all communities to donate 2/6
as Ubayadharar in the said temple. Since the same was considered, he filed a Writ Petition before this Court in W.P.No.15962 of 2025 wherein, this Court had directed the respondents to consider the representation of the petitioner within a period of three weeks. Pursuant to which, the petitioner's representation was considered and the present impugned order has come to be passed rejecting the claim of the petitioner stating that in future, if any petition is given by the petitioner to be a Donator (Ubayadharar) then the same will be considered if there are no pre-existing Donator (Ubayadharar). Aggrieved by which, the petitioner has come up with the present Writ Petition.

Learned counsel appearing for the petitioner submitted that the impugned order passed by the 3rd respondent denying the petitioner his rights to donate as Ubayadharar in the aforesaid temple is wholly arbitrary and illegal as people belonging to only a particular community are allowed to raise funds and donate as Ubayatharar to the temple which is in violation of right to equality guaranteed under Indian Constitution and therefore, he prayed that this Court may issue a direction to the respondents to permit the petitioner to donate as Ubayadharar to the respondent temple in the near future. 3/6
5. Learned Additional Government Pleader (HR &CE) appearing for the respondents submitted that, in the next year, the petitioner's name will be included in the list of donors and his donation as Ubayadharar to the respondent temple will be considered.
6. Recording the submission made by the learned Additional Government Pleader (HR & CE), this Writ Petition stands disposed of. There shall be no order as to costs.
