2.This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure seeking withdrawal of H.M.O.P. No.1389 of 2024

pending on the file of the III Principal Additional Family Court, Chennai, and transfer of the same to the file of the Sub Court, Tiruchendur, for disposal in accordance with law.

3. The marriage between the petitioner and the respondent was solemnized on 09.02.2017 at Rajalakshmi Hall, Poonamallee High Road, Chennai as per Hindu rites and customs. The respondent husband filed OP.No.1389 of 2024 before the III Principal Additional Family Court, Chennai, seeking dissolution of marriage.

4. It is the case of the petitioner that the petitioner is residing at Tiruchendur and has to travel about 700 Km for every posting. The petitioner is residing with minor child. The petitioner has no independent source of income and cannot afford the recurring travel. It is also noted that the matrimonial case is in the pre-trial stage.

Considering the above circumstances, particularly the convenience of the petitioner-wife who has to attend Court along with a tender-aged child, and also having regard to the stage of the proceedings, this Court is satisfied that the transfer sought deserves to be ordered. 6.

In the result, Tr.C.M.P. No.1043 of 2025 is allowed. H.M.O.P. No.1389 of 2024 pending on the file of the III Principal Additional Family Court, Chennai is withdrawn and transferred to the file of the Sub Court,

Tiruchendur. The III Principal Additional Family Court, Chennai shall transmit the entire records in H.M.O.P. No.1389 of 2024 to the Sub Court, Tiruchendur within three(3) weeks from the date of receipt of this order and the Sub Court, Tiruchendur shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order.
