Heard Mr.R.Selvakumar, learned counsel for the petitioner.

The present petition is filed for recalling the order, dismissing the writ petition in default for non-prosecution.

Learned counsel submits that on 21.11.2023, it was a rainy day and he could not appear in the Court. On the earlier date, he could not appear because of misunderstanding.

Mr.S.Venkatesh, learned counsel for respondent 11 and Mr.E.Sampath Kumar, learned counsel for respondents 12 to 15 opposes the present petition.

We do not find the explanation to be satisfactory, however, because of the lapse of the advocate, the litigant should not suffer. We are inclined to entertain the present petition.

In view of that, the present petition stands allowed. The writ petition shall be placed on 13.02.2024.
