The petitioner seeks to withdraw the case in Cr.No.110 of 2025 on the file of the 3rd respondent herein and transfer the same to the file of the 2nd respondent herein under him to investigate the case in accordance with law.
2. It is the case of the petitioner that the he is confined by the accused and the accused took the diamond of the petitioner and ran away. Thereafter, though the original diamond was seized, the same has not been produced and only a duplicate diamond has been produced before the Court. Hence, seeks for direction.

The learned Government Advocate (Crl.Side) on instructions submitted that every seizure of things has been recorded and video footage is produced before the Court and the contention of the petitioner is absolutely false and the investigation is already completed and it is in PRC stage. It is also the contention of the learned Government Advocate (Crl.Side) that when the petitioner was arrested and produced before the learned Judicial Magistrate, he has identified the diamond seized from them, however, now, the petitioner has come up with a different story. 2/4
4. Heard both sides and perused the materials placed on record.
5. The nature of the complaint indicate that there is a doubt in the mind of Court about the complainant's case. The petitioner has not even accounted for such diamond. Therefore, at this stage, there cannot be any direction to transfer the investigation.
