This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 39 days in filing the above Criminal Revision Case against the order dated 28.04.2025 passed in Crl. M.P.No.2848 of 2025, on the file of Judicial Magistrate No.I, Nagapattinam.

2. Mr.K.Balu, learned counsel for petitioner submitted that the petitioner had obtained certified copy of order only on 19.05.2025 and thereafter, he engaged the present counsel for filing this Criminal Revision Case. Hence, the petitioner is not able to prefer the above Criminal Revision case within a stipulated time and only during month of September 2025, he gave papers to him, as a result of which, there is a delay of 39 days in filing the above Criminal Revision Case arose, which is neither willful nor wanton. Therefore, he filed this petition to condone the delay in filing the above Criminal Revision Case.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition.
