O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 296(b), 115(2), 118(1) and 351(3) of BNS Act, 2023 in Crime No.242 of 2025, on the file of the respondent police, seeks anticipatory bail.

2. The prosecution case is that the petitioner along with other accused 1/4

went to the shop of the defacto complainant and after consuming food refused to pay the money. When the same was questioned, there was an altercation resulting which the petitioner abused and assault the defacto complainant and caused injuries. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as stated by the defacto complainant and he has been falsely implicated in this case. He further submitted that he is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) for the respondent police, reiterated the prosecution case and reported that totally two accused in this case and that the petitioner is ranked as A4. He further submitted that the petitioner is having six previous cases. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the above facts and circumstances of the case, taking note 2/4

of the submission made by the learned Government Advocate (Criminal Side), nature of allegation and also the fact that the petitioner is having six previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
