O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 303(2), 326(a) of BNS, 2023 (U/s.379, 430 of IPC) in Crime No.127 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that he illegally quarried 4 units of sand from lake thereby caused damage to the ecology and also water body. Hence, the case has been registered.

3. The learned counsel for the petitioner submitted that he is not having any previous cases and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal side) for the respondent police reiterated the prosecution case and submitted that the petitioner illegally quarrying four units of river sand and two units of sand has been recovered and no previous case has been registered against him. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the fact that the petitioner had illegally quarrying the river sand, the occurrence had taken place and also the over tack against the petitioner is that the petitioner caused damage to ecology and water body, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. 23.09.2025 ssi 2/4
