No.618 of 2025.

2. These cases in Cr.Nos.05, 03, 06, 04 and 07 of 2018 were registered for the alleged offences under Section 3(a) RP(UP) Act 1966. In all these cases, the accused were found to be in possession of various quantities of railway properties and hence all these cases came to existence at the same time. The propety has been recovered and handover to the railways on behalf of the said organisation. It is represented that they are unable to trace the accused and they have no objection in the case being closed.

3. Considering this as an extraordinary case since there is no other case subsequent to the said period and the accused remaining elusive, the cases are pending in sumons stage. It is evident that even if the accused is brought to face trial, it would impinge upon his right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served.

4. Accordingly, the cases in C.C.Nos.101, 102, 103, 104 and 105 of 2022 on the file of the District Munsif cum Judicial Magistrate Court, Gummidipoondi Taluk, Tiruvallur stands quashed. These Suo Motu Transfer Cases are disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned. 2.

Since, this common order is typed for all the above mentioned cases, the Court concerned is directed to treat this order as separate order for all the aforementioned cases and type the cause title for each and every case.
