Petition for relaxation of the conditions imposed to the petitioner in Crl.M.P.No.5436 of 2023 in Crl.A.No.430 of 2023 dated 19.04.2023.

2. The learned counsel for the petitioner would submit that this Court, while suspending the sentence, directed the petitioner to appear before the Trial Court on the first working day of every alternate English Calendar Month, at 10.30 a.m., starting from April 2023. H would further submit that the petitioner is diagnosed with Stage IV cancer in the lungs and he is continuously taking treatment at Adyar Cancer Institute, Chennai and due to his illness, he is unable to appear before the Trial Court and thereby, the present petition has been filed for relaxation of the said condition.

3. The learned Government Advocate (crl.side) appearing for the respondent admits that the petitioner is suffering with cancer.

4. Taking into consideration the said facts, the condition imposed on the petitioner in Crl.M.P.No.5436 of 2023 dated 19.04.2023 is modified to the effect that the petitioner shall appear before the Trial Court once in four months, starting from the first working day of April 2024, at 10.30 a.m. until further orders. In the event of the petitioner being unable to appear before the Court on account of his illness/treatment, necessary memo shall be filed through the counsel before the Trial Court on that date.
