Respondents Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, directing the 1st respondent to consider the recommendation of 2nd respondent in proceeding No.Na.Ka.A1/2639/2022 dated 27.04.2023 and pass appropriate orders promoting the petitioner to the post of Deputy Collector, with effect from the date on which his junior Mrs.Bhanumathi and Mr.K.Vijayan promoted as Deputy Collector and pay all arrears of salary and other benefits including Revision of his pension.

ORDER

This Writ Petition has been filed for a direction directing the first respondent to consider the proposal sent by the second respondent and pass order to promote the petitioner to the post of Deputy Collector.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner had entered into service under the first respondent and promoted to the post of Tahsildar on 13.03.2015. He attained the age of superannuation and retired from his service as Special Tahsildar flying Squad on 31.05.2023. In the year 2012 itself, his name was found in Serial Number 11 in the above panel for promotion to the post of Deputy Collector. When the petitioner was waiting for his promotion to the post of Deputy Collector, his juniors were promoted to the post of Deputy Collector. Therefore, the petitioner submitted a

representation, while he was in service on 24.04.2023 before the second respondent. The second respondent, after considering the request made by the petitioner, had sent proposal dated 27.04.2023, thereby recommended the case of the petitioner for promotion to the post of Deputy Collector. However, it is pending on the file of the first respondent, without passing any order.

4. Considering the above facts and circumstances of the case, the first respondent is directed to pass appropriate orders on merits and in accordance with law on the communication sent by the second respondent dated 27.04.2023, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. No costs.
