O R D E R
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 115(2), 118(1) and 109 of BNS, 2023 read with Section 4 of TNPWH Act, in Crime No. 195 of 1/6
2025, on the file of the respondent Police, seeks anticipatory bail.
2. The allegation against the petitioner is that on 21.08.2025 at about 11.00 a.m., the de-facto complainant and his wife were travelling in a two wheeler, at that time, the petitioner/A2 along with A1 came in a Tractor with Trailer, dashed against the two wheeler and they had assaulted both the defacto complainant and his wife due to a family dispute. Due to the impact, both of them had multiple grievous injuries and later, they were taken to a hospital. Based on a complaint given by the de-facto complainant, the respondent police registered an FIR against the petitioner and others. 3.The learned Counsel for the petitioner submitted that there was quarrel between the petitioner and the de-facto complainant. He further submitted that the wife of the de-facto complainant had already been discharged from the hospital. He further submitted that the petitioner has 2/6
not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court.
4.The learned Government Advocate (Criminal Side) appearing for the respondent submitted that the wife of the de-facto complainant had sustained severe injuries, her entire face has been disfigured and severe fractures were caused to the victim. He further submitted that investigation has been pending against the petitioner and others. 5.Taking note of the fact that the petitioner ran over his Tractor with trailer on the victim lady who is the wife of the de-facto complainant and caused severe fractures in all over her body, this Court is not inclined to grant anticipatory bail to the petitioner herein.
6. Accordingly, this Criminal Original Petition is dismissed. 3/6
