Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to fix the pay structure of the Petitioners by adopting the 2.57 multiplier factor by taking in to account of 7th Pay Commission with effect from the date of their re designation as Junior Engineer/Assistant Engineer and pay the consequential difference of salary with 10 Percent interest per annum along with the terminal benefits in the light of the Order of earlier W.A(MD) No.1099 of 2024 dated 04.07.2024 confirming the Order on W.P(MD) No.3609 of 2020 dated 20.06.2023 within the period that may be stipulated by this Court. ORDER

Ms.S.Pavithra, learned Standing Counsel takes notice for the respondents. With the consent of both the learned counsel, the main writ petition is taken up for final disposal.

2. The above writ petition is filed for issuance of a writ of mandamus, directing the respondents to refix the pay of the petitioner by adopting 2.57 multiplier/ Matrix on a par with 7th Pay Commission from the date of promotion and pay the consequential difference of salary with 10 Percent interest per annum along with the terminal benefits within a stipulated time prescribed by this Court pursuant to the representations of the petitioners.

The case of the petitioners is that they joined the respondent Corporation in the year 1984 as Junior Tradesman and after rendering several years of service, the petitioners 1 to 14 had retired from service in the year 2017 as Junior Engineers / Assistant Engineers and the petitioners 15 & 16 are continuing their services as Junior Engineers / Assistant Engineers. The grievance of the petitioners is that upon their promotion on 29.02.2016, they are entitled to pay fixation as per G.O.Ms.No.134, Transport Department, dated 09.04.2018. However, based on G.O.Ms.No.330 dated 31.10.2018 of the very same Department, the petitioners' pay was fixed using the Multiplier 2.44 instead of 2.57. Hence, the petitioners sent a representations to the respondents

on 30.06.2025, 29.06.2025, 15.07.2025, 19.07.2025, 14.07.2025 and 11.07.2025. Since the said representations have not evoked any response, the petitioners have filed the above writ petition for the aforesaid relief.

The learned counsel for the petitioners would submit that it would suffice if a direction is issued to the respondents to consider and dispose of the petitioners' representations dated 30.06.2025, 29.06.2025, 15.07.2025, 19.07.2025, 14.07.2025 and 11.07.2025 within a time frame to be fixed by this Court.

5. Heard both sides and perused the materials placed on record.

Under the facts and circumstances of the case and considering the limited prayer now sought for by the learned counsel for the petitioners, a direction is issued to the respondents to consider and dispose of the petitioners' representations dated 30.06.2025, 29.06.2025, 15.07.2025, 19.07.2025, 14.07.2025 and 11.07.2025, on merits and in accordance with law, within a
