When the matter is taken up for hearing, the learned Government Advocate (crl.side) submitted that the petitioner had been taken into custody on 25.01.2024.

2.The respondent have every right to take custody of a person whether the anticipatory bail application is pending before the Court or not. Once an every individual is accused of commission of a cognizable offence, then, even if anticipatory bail application is pending, the respondent have every right to take him into custody. The respondent need not take any permission from any Court or from any person for that particular purpose. The respondent have correctly taken the petitioner into custody.
