ORDER

This Writ Petition has been filed for issue of writ of mandamus, directing the respondents to consider the representation made by the petitioner on 09.08.2024, wherein the petitioner has sought for issuance of patta in his name with respect to the subject property.

2.Heard Mr.S.Kausik, the learned counsel appearing on behalf of the petitioner and Mr.A.Selvendran, the learned Special Government Pleader appearing for the respondents.

3.The case of the petitioner is that the subject property belongs to one Kuzhanthai. After his life time, his children wanted to partition the property and 2/6

allot shares. Accordingly, the partition deed dated 25.02.2014 was executed and it was also registered as Document No.1762 of 2014. As per the partition deed, the 'B' schedule was allotted to the petitioner. The petitioner made an online application seeking for separate patta in his name. The petitioner also paid the necessary fees seeking for sub division and issuance of patta. The online application submitted by the petitioner was rejected without assigning any reasons through proceedings dated 07.08.2024 by the 2nd respondent. Thereafter, the petitioner made a detailed representation to the respondents, which was not considered. Aggrieved by the same, the present writ petition has been filed.

4.Taking into consideration the facts and circumstances of this case, and considering the limited relief sought for by the petitioner and taking note of the fact that the petitioner is tracing his right to the registered partition deed dated 25.02.2014, there shall be a direction to the petitioner to submit a fresh online application to the 2nd respondent. The 2nd respondent shall consider the same, and if there are any queries, the petitioner shall be called for an enquiry and petitioner shall submit all the relevant documents. The final order shall be passed 3/6

by the 2nd respondent within a period of six (6) weeks from the date of the receipt of the online application made by the petitioner. 5.The Writ Petition is disposed of with the above direction. No costs. 03.02.2025 Index : Yes / No kas To.
