Criminal Original petition has been filed under Section 482 of Cr.PC to set asie the impugned order dated 16.11.2023 in Crl.M.P.No.49068 of 2023 in C.C.No.3792/2017 on the file of the learned Metropolitan Magistrate, for CCB and CBCID cases, at Egmore, Chennai and consequently modify the condition imposed on the petitioner / 1st accused in Crl.M.P.No.49068/2023 in C.C.No.3792 of 2017 on the file of the learned Metropolitan Magistrate, for CCB & CBCID Cases, at Egmore, Chennai and reduce the value of surety. ORDER

This petition has been filed seeking for modification of the condition with respect to reduction of the value of surety, imposed by the Court below while granting bail to the petitioner.

The learned counsel for the petitioner submitted that the petitioner is aggrieved by the condition imposed by the Court below, wherein, the Court below has directed the petitioner to produce two sureties to execute bond each for a like sum of Rs.25,000/- and one of such sureties shall either have an immovable property worth sum of Rs.10,00,000/- or have a bank account with balance sum of Rs.10,00,000/- and prays to reduce the value of surety.

3. The learned Government Advocate (Crl.Side) submitted that the trial Court has enlarged accused on bail by imposing conditions and has no objection to modify the conditions.

4. Considering the submission made by the learned counsel appearing for the petitioner and considering that the present condition is onerous, this Court is inclined to modify the condition imposed by the trial Court in Crl.MP.No.49068 of 2023 in C.C.No.3792/2017 dated

16.11.2023 in respect of value of sureties alone. The petitioner is directed to produce two sureties and one of such sureties shall have an immovable property worth sum of Rs.2,00,000/- or have a bank account with balance sum of Rs.2,00,000/-. The condition imposed by the Trial Court is modified accordingly and all other conditions shall remain intact.
