J U D G M E N T

(Judgment of the Court was made by R.SUBRAMANIAN, J.) Aggrieved by the order of the learned single Judge, quashing the withdrawal of declaration of probation of the respondents 3 to 10, the appellants, who are third parties have come up with this appeal.

2. The grievance of the appellants is that the respondents have been promoted in excess of the quota that is available for the promottees and if 2/4

the probation of the respondents 3 to 10 is declared in the promoted post that will affect the seniority of the appellants, who are direct recruits.

3. We do not see it as a justifiable grievance. The issue relating to seniority is pending in W.P.Nos.29670 of 2015, 15973 of 2018, 14887, 15623 & 16924 of 2019, 1857 of 2020 & 22881 of 2023. The question of inter-se-seniority to the direct recruits as well as the promottees will have to be decided in those writ petitions and the declaration of probation will not affect the inter-se-seniority, which will be governed by the decision in those writ petitions. Hence, we see no reason to entertain the appeal.
