Mr.V.Ramana Reddy Transfer Civil Miscellaneous Petition filed under Section 24 CPC to withdraw the H.M.O.P.No.231 of 2023 on the file of the Family Court, Chengalpattu and to transfer the same to the Family Court, Kancheepuram.

ORDER

This petition has been filed to withdraw H.M.O.P. No.231 of 2023 from the file of the Family Court, Chengalpattu and transfer the same to the file of the Family Court, Kancheepuram..

Heard the learned counsel on both sides.

The learned counsel appearing for the petitioner would submit that the respondent/husband filed an application for divorce before the Family Court, Chenglepattu and the same is pending in H.M.O.P.No.231 of 2023. The petitioner/wife is taking care of her minor female child aged about 2 years and also depending on her parents to meet out the day-to-day expenses. The petitioner is also finding it difficult to meet the expenses and also travel to Chengalpattu to attend the case.

Per contra, learned counsel for the respondent would submit that the petitioner has filed an application in M.C.No.34 of 2024 pending on the file of the Family Court, Chengalpattu and the same has also to be transferred. Learned counsel for the petitioner would submit that M.C.No.34 of 2024 is at the stage of inquiry.

I have gone through the affidavit filed in support this petition and I find merit in the submissions made by the learned counsel for the petitioner/wife.

Considering the convenience of the wife as well as taking into consideration the age of the child, the proceedings in H.M.O.P.No.231 of 2023 on the file of the Court of the Family Court, Chengalpattu, is withdrawn and transferred to the file of the Family Court at Kancheepuram. Accordingly, the Transfer Civil Miscellaneous Petition stands allowed. No costs.
