This Criminal Original Petition has been filed by the petitioner to direct the Judicial Magistrate No.1, Namakkal, to complete the trial in Crl.M.P.No.5212 of 2023 pending on his file as expeditiously as possible with the time as may be stipulated by this Court.

The case of the petitioner is that the petitioner had lodged a complaint against the respondent before the Velagoundampatty Police Station and he was issued C.S.R.No.111 of 2022 on 13.09.2022 and the petitioner had also sent a complaint to the Namakkal District Superintendent on 21.03.2023, but no action was taken. Hence, the petitioner filed a petition in Crl.M.P.No.5212 of 2023 before the Judicial Magistrate No.1, Namakkal District under Section 156(3) of Cr.P.C. seeking direction to register FIR against the respondent. Though the said petition was filed on 08.06.2023 itself, still the trial has not been completed. Hence, the present petition is filed.

3. Heard the learned counsel for the petitioner and perused the materials available on record. Since no adverse order is being passed against the respondent, notice to the respondent is dispensed with.

4. Considering the facts and circumstances of the case, the Judicial Magistrate Court No.1, Namakkal is directed to give opportunity to both the parties and dispose of the case in Crl.M.P.No.5212 of 2023 as early as possible. 2/4

5. With the above directions, this Criminal Original Petition is disposed of.
