ORDER

(Order of the Court was made by S.M.Subramaniam J.) Writ of Mandamus has been instituted to forbear the respondents from in any manner permitting or allowing any construction/erection of unauthorized religious temple in S.No.51,Nariyampadi village, Chetpet Taluk, Tiruvannamalai District, contrary to the Judgement of the Honble Supreme Court of India in SLA (Civil)No.8519 of 2006 dated 18.1.2013 and 31.1.2018 and consequently, direct the respondents to remove the unauthorized construction and encroachment made in the S.No.51,Nariyampadi village, Chetpet Taluk, Tiruvannamalai District.

The Tahsildar, Chetpet, Tiruvannamalai District, filed a counter affidavit stating that the survey conducted would reveal that S.No.51 is a Government land and no permission or approval has been granted by the official respondents or by any competent authority for construction of any religious structure, statue or temple in the subject land.

3. In view of the aforesaid affidavit filed by the Tahsildar, Chepet, Tiruvannamalai District, the competent authorities are bound to initiate appropriate action to evict the encroachers. Encroachments are to be removed by following the procedures as contemplated under the relevant statute and by affording opportunity to all the parties including the encroachers. Such exercise is directed to be completed within a period of twelve weeks from the date of receipt of a copy of this order.
