O R D E R

This criminal original petition has been filed seeking for the transfer of investigation in Crime No.319 of 2023 pending investigation on the file of the 2nd respondent.

2.The learned Additional Public Prosecutor on instructions submitted that the FIR was registered against two named accused persons for offence punishable under Section 304(2) of IPC. The learned counsel further submitted that out of the two accused persons, A1 was arrested and later enlarged on bail. A2 was granted anticipatory bail. The learned Additional Public Prosecutor further submitted the investigation is in progress and that it will be completed as expeditiously as possible.

3.Taking into consideration the facts and circumstances of the case and the grounds that have been raised in this transfer petition, this Court is not inclined to transfer the investigation at this stage. There shall be a direction to the 2nd respondent to complete the investigation and to file the final report before the 2/4

concerned jurisdictional Court, within a period of three months from the date of receipt of copy of this order.

4.This criminal original petition is disposed of with the above directions.
